AN ORDINANCE OF THE CITY COUNCIL OF APPROVING A ZONE CHANGE FROM ROUTE 66 SERVICE COMMERCIAL (RT66-RSC) TO CENTRAL ROUTE 66 RESIDENTIAL (RT66-CRR) AND COMPLIANCE WITH CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) ON CERTAIN PROPERTY LOCATED AT 723-731 EAST ROUTE 66, GLENDORA, CALIFORNIA (FILE NUMBER: PLN23-0027)

THE CITY COUNCIL OF THE CITY OF GLENDORA DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, Brandywine Homes filed an application requesting approval to amendment the Glendora Zoning Map as well as the Route 66 Corridor Specific Plan pursuant to the Central Route 66 Residential (RT66-CRR) zone; Development Plan Review to allow construction of 39 three-story residential townhomes; Vesting Tentative Tract Map to consolidate two parcels and subdivide the 1.85-acre site to create a condominium development with 39 residential units on certain property located at 723-731 East Route 66, Glendora, California (Project No. PLN23-0027); and
WHEREAS, Pursuant to Glendora Municipal Code §21.10.320 (F): “The Central Route 66 district is intended to contribute to the mix of housing choices offered to Glendora residents and provide consistency with the Glendora general plan housing element, through the provision of higher density multifamily residential development.;” and
WHEREAS, the environmental review for the project’s Specific Plan and Zone Change, DPR, and Vesting Tentative Tract Map was processed in accordance with the requirements of the California Environmental Quality Act (CEQA) and the Initial Study and Mitigated Negative Declaration (IS/MND) was available for public review from July 19, 2024, through August 19, 2024.
WHEREAS, a public hearing was held by the Planning Commission of the City of Glendora (Planning Commission) on September 3, 2024, after due notice was given as required by law, at which time oral and documentary evidence was introduced along with the written analysis of the Planning Division of the City of Glendora, and the Planning Commission recommended approval of Project No. PLN23-0027 to the City Council of the City of Glendora (City Council); and
WHEREAS, the City Council held a public hearing on September 24, 2024, after due notice was given as required by law, at which time oral and documentary evidence was introduced along with the recommendation of the Planning Commission.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GLENDORA, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated by reference.
SECTION 2. The City Council based on the evidence in the record inclusive of the staff report, and written/oral testimony, hereby approves a zone change designation from Route 66 Service Commercial (RT66-RSC) to Route 66-Residential (RT66-CRR) change on certain properties at 723-731 East Route 66, Glendora, California (File No. PLN 23-0027) and shown on Exhibit A:

SECTION 3. Findings. The City Council finds that public necessity, general welfare, good planning practices, public interest, and convenience warrant approval of the General Plan Amendment.
- General Plan.The City Council finds that the project is consistent with the General Plan goals and policies, any operative plan, or adopted policy.
- Zoning.The project does not affect the implementation of the General Plan with respect to surrounding properties.The proposed project is consistent with the purpose of the zoning ordinance to promote and protect the public's health, safety, peace, comfort, convenience and general welfare.
- CEQA.The potential impacts of the proposed project have been assessed as required by CEQA as noted above, and have been determined not to be detrimental to the public health, safety, or welfare, and will not have a significant impact on the environment.
As such, approval of these items would be in the best interest of the City.
SECTION 4. Consistent with the requirements of CEQA, the potential environmental impacts of this Zone Change were assessed in the mitigated negative declaration recommended for adoption by the Planning Commission on September 3, 2024. More specifically, the Planning Commission recommended to the City Council adoption of a mitigated negative declaration and mitigation monitoring and reporting program for this Project, all of which is approved concurrently herewith.
SECTION 5. Severability Clause: If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unenforceable by a court of competent jurisdiction, the remaining portions of this Ordinance shall nonetheless remain in full force and effect. The City Council hereby declares that it would have adopted this Ordinance irrespective of the invalidity of any particular portion thereof.
SECTION 6. Repealer Clause: If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unenforceable by a court of competent jurisdiction, the remaining portions of this Ordinance shall nonetheless remain in full force and effect.
SECTION 7. Effective Date: The Mayor shall sign this Ordinance and the City Clerk shall attest and certify to the passage and adoption thereof and cause same to be published at least once in the San Gabriel Valley Examiner, a weekly newspaper of general circulation, published in the City of Glendora, which newspaper is hereby designated for that purpose (California Government Code § 40806). This Ordinance shall be effective on the thirtieth (30th) day after its adoption by the City Council.
